WellPledge Terms of Service, Policies, and User Agreement

Welcome to WellPledge! By using our platform, you agree to the following terms, policies, and user agreement, which are designed to ensure a safe, transparent, and effective fundraising experience. WellPledge is committed to upholding the integrity of all campaigns and reserves the right to terminate, cancel, or decline any campaign that violates our policies or operational framework.

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the WellPledge platform, including all associated services and features ("Services"). By using WellPledge, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use of the platform immediately.

2. Eligibility

To use WellPledge, you must:

  • Be at least 18 years old or have the authorization of a parent/guardian.
  • Provide accurate and complete information during the account registration process.
  • Use the platform in compliance with applicable laws and these Terms.

3. Fundraising Campaigns

3.1 Creating a Campaign

  • All campaigns must be for lawful purposes and align with WellPledge’s mission to facilitate legitimate fundraising efforts.
  • Campaign organizers are responsible for the accuracy of their campaign descriptions, goals, and intended use of funds.
  • WellPledge reserves the right to request additional documentation or verification for any campaign before approval.

3.2 Prohibited Campaigns

Campaigns that promote or support the following are strictly prohibited:

  • Fraudulent, misleading, or deceptive practices.
  • Illegal activities or the solicitation of funds for illegal purposes.
  • Hate speech, violence, discrimination, or harassment of any kind.
  • Exploitation of minors, personal hardships without verifiable consent, or any activity deemed unethical.
  • Misinformation or campaigns designed to mislead donors.
  • Any campaign that violates federal, state, or local laws.

3.3 Campaign Review and Approval

  • All campaigns are subject to review and approval by WellPledge before being published.
  • Campaign reviews typically take up to 24 hours but may take longer if additional verification is required.
  • WellPledge reserves the right to decline, remove, or suspend any campaign at its sole discretion without prior notice.

4. Donations and Payouts

4.1 Donation Processing

  • All donations made through WellPledge are final and non-refundable unless deemed necessary by WellPledge due to a policy violation.
  • WellPledge processes payments through a third-party payment processor. Users must agree to the terms of the payment provider.

4.2 Payouts to Campaign Organizers

  • Campaign organizers must provide valid banking information upon completion of a successful campaign to receive funds.
  • WellPledge reserves the right to withhold or delay payouts if fraudulent activity is suspected.
  • Transaction fees apply to all donations, as disclosed on the platform.

5. User Conduct

  • Users must engage with the platform in good faith and refrain from abusive, fraudulent, or deceptive practices.
  • Harassment, threats, or inappropriate behavior towards WellPledge staff, donors, or other users will result in account termination.
  • Users must not attempt to manipulate, hack, or otherwise interfere with WellPledge’s platform and systems.

6. WellPledge’s Rights and Responsibilities

  • WellPledge reserves the right to modify, suspend, or discontinue any portion of the Services at any time.
  • We are not liable for losses or damages resulting from unauthorized access to a user’s account.
  • WellPledge is not responsible for how funds are ultimately used by campaign organizers but encourages transparency and ethical use.

7. Account Suspension and Termination

  • WellPledge reserves the right to terminate or suspend any account that violates our Terms or policies.
  • We may remove or cancel any campaign that does not comply with our operational framework or legal obligations.
  • Users may request account deletion, but WellPledge reserves the right to retain certain records for compliance and security purposes.

8. Dispute Resolution

  • Any disputes arising from the use of WellPledge shall first attempt to be resolved amicably through written communication.
  • If necessary, disputes shall be resolved through arbitration in the State of Maryland in accordance with Maryland laws.
  • Users agree to waive the right to a trial by jury or class action lawsuit.

9. Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.

10. Changes to These Terms

  • WellPledge reserves the right to update or modify these Terms at any time. Continued use of the platform constitutes acceptance of the updated Terms.
  • Users will be notified of significant changes through platform notifications or email.
